The injunction filed by record label Chocolate City against its estranged artiste, Brymo, has been lifted by Justice I. Buba of the Federal High Court sitting yesterday in Ikoyi Lagos.
‘Since the plaintiff (Chocolate City) can be compensated at a later date, the defendant is free to carry out his duties as a singer so that none of the parties will be at a disadvantage,’ Justice Buba said.
At the court sitting, Chocolate City’s counsel, T.O Lawal, insisted that the primary concern of the court should be the case of the contract breach by Brymo and not the failure of Chocolate City to fulfil its promise as accused by Brymo.‘Because of the peculiarity of Brymo’s job, money cannot compensate the record label so the injunction should stand,’ Lawal said.
Brymo’s counsel, Nike Olagbede, after apologising to the court for her unruly behaviour last week, argued that Brymo was right to quit the record label, as the latter could not fulfil its promises.
After lifting the injunction, the judge adjourned the case to give the counsels time to provide witnesses to back up their claims. The case has been adjourned till March 19, 2014.
Dressed in all-black native attire, Brymo was in court with his father and his girlfriend. The artiste declined to comment on the judge’s interlocutory ruling, insisting NET talks to his counsel, Olagbede.
Olagbede confirmed the lifting of the injunction, but was reluctant to speak further on the case.
‘I don’t have the full details of what the judge just said. The injunction, of a truth, has been lifted, but I cannot say more at this point until I get the details,’ she told NET.
No well-known Chocolate City rep was present at the court and the counsels were not available to comment on the lifting of the injunction against Brymo.
